Impounded van that was sold 6yrs ago,was leign sold.

I sold a van 6yrs ago to some mexican guy, sent the releise of liability to the DMV.The guy never registered in his name, and van was towed.BJ said they sent out a letter to the previous owner about the vehicle, that it was goin into a leign sale, which the previous owner never got.IT was sent to a collection agency in the mean time. And 6yrs later while getting a credit check done,we find out that it was handed over to a collection agency, and we were never ever told anything about this or ever contacted. Now the collection agency is asking us to pay 2500.00 dollars to get this of our record. How can they do this, when the van was sold by BJs tow 6yrs ago.ON a leign sale.THIS I JUST PLAIN ROBBERY BY BJs TOW AND THIS COLLECTION AGENCY

:sigh

Sorry to hear about your troubles. Go to the DMV and get a copy of the release of liability you sent to them 6 years ago.

Then contact the Collection Agency and tell them to produce the third party contract between you and them. (They dont have it) then inform them that they are never to contact you again about this supposed debt except in writing and tell them that your exercising your rights granted to consumers by the "Fair Debt Collections Practices Act". That any further correspondence from them is to be sent through the US Postal Service. That should pretty much fix your situation.

You see, if they falsely try to collect a bogus debt through the US Post Office, they are now engaging in postal "Mail Fraud" which is a federal crime.

Hope this helps! :)
